These Terms are the agreement between you and Tabfires (“we”, “us”) about your use of the TClock mobile app. By installing or using TClock you accept them. If you do not accept them, please do not use the app.
TClock rings daily alarms at times you set, and rings a further alarm when your phone comes within a distance you choose of a destination you pick. Location for the second feature is processed entirely on your device, as described in our Privacy Policy, which forms part of these Terms.
An alarm may fail to ring, ring late, or ring silently because of any of the following, none of which is within our control:
Where TClock can detect such a problem it will tell you, and where a settings page exists it will offer to take you there. It cannot detect every case.
For anything important — a flight, an examination, a medical dose, a stop you must not miss — use a second, independent alarm. You accept that you use TClock on that understanding.
Do not use TClock, or look at your phone to check it, while driving or riding. Set your destination before you set off. The location alarm is a convenience for passengers; it is not a navigation system, and it must not be used in place of paying attention to the road, to your surroundings, or to official travel information.
You need an account to use TClock. You agree to give accurate information, to keep your password confidential, and to tell us promptly at the address below if you believe your account has been used without your permission. You are responsible for what happens under your account. You must be old enough to agree to these Terms where you live; see the Children section of the Privacy Policy.
You agree not to reverse-engineer, decompile or tamper with the app except to the extent that law expressly permits despite this restriction; not to use it unlawfully or to harass anyone; not to attempt to gain access to accounts or data that are not yours; and not to interfere with the services the app relies on.
We may change, suspend or discontinue TClock, or any part of it, at any time. We will give reasonable notice of a significant change or of discontinuation where it is practical to do so. The app depends on services operated by Google (Firebase, Google Maps, Google Play services); if those become unavailable, parts of TClock may stop working.
TClock, its name, its design and its code belong to Tabfires and are protected by intellectual-property law. These Terms give you a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control. Nothing else is granted. The content you create — your alarms, notes and destinations — remains yours.
TClock uses Google Maps, and your use of the map is also subject to the Google Maps Platform Terms of Service and the Google Privacy Policy. We are not responsible for third-party services, their content, or their availability.
To the fullest extent the law allows, TClock is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted or error-free operation. We do not warrant that alarms will ring, that they will ring on time, or that location will be measured accurately.
To the fullest extent the law allows, Tabfires is not liable for any indirect, incidental, special, consequential, punitive or exemplary loss, or for loss of profit, revenue, data, goodwill or opportunity, arising out of or connected with your use of, or inability to use, TClock.
This includes, without limitation, any loss arising from an alarm that failed to ring, rang late, rang silently, or did not wake you — such as a missed flight, train, bus or stop; a missed appointment, examination, interview or shift; a missed dose of medication; or any other consequence of not being alerted.
Where liability cannot lawfully be excluded, our total aggregate liability to you for all claims is limited to the greater of the amount you have paid us for TClock in the twelve months before the claim (which, for a free app, is nil) or ₹1,000.
Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or any right you have as a consumer under the law of your country that cannot be waived by agreement. If you are a consumer in the EEA or UK, your statutory rights are unaffected.
You agree to indemnify Tabfires against claims, losses and reasonable costs arising from your breach of these Terms or your misuse of the app, except to the extent they arise from our own breach or negligence.
You may stop at any time by deleting your account in Settings → Delete Account and uninstalling the app. We may suspend or end your access if you materially breach these Terms, or if we discontinue the app. Sections 7, 9, 10, 11 and 13 survive the end of this agreement.
These Terms are governed by the laws of India, and the courts at Chennai, Tamil Nadu have exclusive jurisdiction — except that if you are a consumer, you keep the benefit of any mandatory protections, and any right to bring proceedings in the courts, of the country where you live.
We may update these Terms. The current version is always at this address with its “Last updated” date, and significant changes will be announced in the app. Continuing to use TClock after a change means you accept the updated Terms.
If any provision is held unenforceable, the rest continues in force and that provision is applied as far as it lawfully can be. Our not enforcing a right is not a waiver of it. These Terms and the Privacy Policy are the entire agreement between us about TClock.
